CONSENT TO ENTRY AND RELEASE OF LIABILITY AGREEMENT
I, the undersigned owner of the property, or duly authorized agent representing the property owner at the property site described herein, hereby consent to entry upon said property by the City of El Paso and its officers, employees, agents and volunteers for the specific purpose of removing, reducing or obliterating graffiti from my property by the use of multi-media blasting, painting, solvents, or similar methods for the twelve-month period beginning on the date listed below.
I understand that the cleaning of graffiti, if any, may be done in blocks or strips only where the writing appears; that the cleaned, processed, or coated area may not match; that the cleaning of graffiti may not include the entire surface but only blocks, patches or strips thereof; and that the City of El Paso, its officers and employees assume no responsibility if colors or paint do not match; if damage occurs in the removal process; if some shadow of the existing graffiti remains, or if some residue of the media used in the removal process remains on or is left on the property or ground.
I request and authorize the City of El Paso, its officers, employees, agents and volunteers to enter the described property site and to use the necessary materials and equipment for the removal of graffiti with full knowledge of the above, and without giving me separate notice prior to the entry or removal of any graffiti during the period of time in which this agreement is in effect.
I hereby release the City of El Paso, its officers, employees, agents and volunteers from any and all liabilities, claims, demands, causes of action or obligations whatsoever, known or unknown, directly or indirectly arising out of or relating to entry on my property or graffiti removal; including, without limitation, all liabilities, claims, demands, causes of action or obligations including personal injury, death and property damage, arising out of the entry on the property, damages caused by or occurring in connection with the cleaning or removal services; the appearance or condition of the property after the cleaning or removal; the use of photographs, videotapes or films of the property; or any incidental damage to shrubs, plants or landscaping or any other personal property or equipment located on my property.
I agree that in the event that I sell the property, if I am an authorized agent of the property owner and I become no longer authorized to consent to the removal of graffiti during the time in which this Agreement is in effect, or I wish to cancel this Agreement before it expires, I will immediately notify the City by calling the Street Department at 621-6789, weekdays between the hours of 7:00 a.m. and 4:30 p.m. This agreement shall expire twelve months from the date listed below.
NOTICE: A RENTER OR TENANT CANNOT SIGN THIS AGREEMENT UNLESS THE OWNER ALSO SIGNS IT.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND THE OBLIGATIONS THAT IT CREATES. I AM LEGALLY ABLE AND AUTHORIZED TO SIGN THIS AGREEMENT AND VOLUNTARILY ENTER INTO THIS AGREEMENT AND GIVE MY CONSENT TO ENTRY AND RELEASE OF LIABILITY AS SET FORTH HEREIN.
