A studio owner seeking to perform tattooing and/or the application of body art, such as body piercing or any other permanent modification of the human body is required to register their business with the City of El Paso. The term of a registration will coincide with the studio's tattoo or body piercing license issued by the Texas Department of State Health Services. The business location must meet the established zoning guidelines and a current, valid certificate of occupancy for the studio is required. Tattoo studios are subject to inspections by code enforcement officers who may enter at all reasonable times any studio to inspect, enforce and investigate any unsafe condition or violation. Artists employed or contracted by the studio must possess a valid tattoo and body artist license issued by the City of El Paso.


A studio registration is non-transferable to any person for any use or benefit. Any change in ownership or registered studio location will require a new studio registration application and registration.

Apply

To register your tattoo & body artist studio with the City, you must submit an application and pay the established fee.  Submittal and payment can be done online, in person, e-mail, mail or fax.  Upon receipt of a proper application and payment of the established fee, the permit official will review and process the application. In the event the permit official denies the application, the applicant will be notified in writing as to the reason(s) for the denial.

Tattoo & Body Artist Studio Fees:

The studio must pay to the City all established fees for the registration provided in accordance with Chapter 5.10 of the City Code.    Note: application and registration fees are non-refundable.

  • Application Fee: $60.00
  • Registration must coincide with expiration date of Texas State License:  $12.50 per month
  • Re-inspection fee, if applicable: $45.00
  • Credit Card Fee (if applicable): 1.98% of total payment
  • E-Check (if applicable):  0.18 cents per transaction

Registration Term and Transferability:

  • The City required studio registration expires on the same date the required state license expires.
  • A studio registration shall not be transferred to any person for any use or benefit.
  • Any change in ownership or registered studio location shall require a new studio registration application and registration.

Renew

Studios registered with the City must apply to the permit official for renewal of registration no more than sixty days prior to the expiration of the license to prevent a lapse in licensing.  Applications for renewal shall be processed in the same manner as an original application.

Cancel

To cancel your registration, it is suggested that you submit a request in writing in person, by email, mail or fax.  The letter must be from the studio owner and include the registration number and reason for cancellation. Note: application and registration fees are non-refundable.

Enforcement

Inspections:

  1. An authorized City of El Paso official may enter at all reasonable times any studio to inspect, enforce, investigate any unsafe condition or violation and perform any duty imposed under ordinance or by state or federal law. If such studio is occupied the City official shall first present proper credentials and request entry. If unoccupied, an effort shall be made to locate the owner or other person responsible for the premises to request entry.

  2. If such entry is denied or permission cannot be obtained, the City official shall have recourse to every remedy provided by law to secure entry

  3. When the City official obtains a legal inspection warrant or other remedy to secure entry, the owner, occupant or person having charge, care or control of the building or premise shall, upon a proper request, promptly permit the director entrance to inspect and investigate pursuant to this chapter or other applicable state or federal law.

  4. The City official will record all findings on an inspection report and furnish a copy of the report to the owner or person in charge. 

  5. The City official will provide a written notice, by means of the inspection report or otherwise, to the owner or person in charge of the studio when a violation of any provision of Chapter 5.10 of the City Code or other applicable state or federal law is determined, which will include:

    1. A description of each violation;
    2. A specific, reasonable time period for correction of each violation;
    3. A statement that the artist who receives said notice, or the owner or person in charge of the studio receiving said notice, may request a re-inspection through the city's appropriate office and pay the re-inspection fee authorized by city council; and
    4. A statement that the registration is subject to suspension or revocation and that legal action may be taken for failure to comply with the notice. 

  6. In addition to studio inspections, an artist may be subject to inspection either during the studio inspection, or as a result of a scheduled inspection arranged by a City official.

The permit official or other authorized City official is authorized to administer and enforce the provisions and to issue citations to any person violating the provisions of Chapter 5.10 of the City Code.

Revocation

An authorized official of the City of El Paso may issue a written notice of intent to suspend for not more than sixty days or a written notice of intent to revoke an original or renewal registration or license subject to this chapter if the City official determines that any of the following is true:

1. The registration holder supplied false or misleading information on any application for a registration;

2. The Texas Department of State Health Services has suspended or revoked the registrant's tattoo or body piercing registration or license;

3. The registration holder is found, after notice and opportunity for hearing, to be in violation of a provision of this chapter or a rule adopted under Chapter 5.10 of the City Code;

4. The registration holder is indebted to the city for fees or payment of penalties imposed by Chapter 5.10 of the City Code or by a rule adopted under this chapter; or

5. The license holder is found, after notice and opportunity for hearing, to have been intoxicated on the licensed premises.

An authorized City official may issue a written notice of intent to revoke a studio registration, as applicable, if the studio owner or licensed artist violates this chapter on two or more occasions within a twelve-month period.
