NOTICE OF ADOPTION

Notice is hereby given that, during a regular meeting of the City Council held on OCTOBER 30, 2018, the Mayor has approved and the City Council has passed the following Ordinances:

ORDINANCE 018865 An Ordinance changing the zoning of A portion of Tracts 17B & 17C, Section 8, Block 79, Township 3 of the Texas and Pacific Railway Company Surveys, North of Vista del Sol Drive & West of Joe Battle Blvd., City of El Paso, El Paso County Texas from R-3 (Residential) to C-1 (Commercial), and imposing a condition. The Penalty is as provided for in Chapter 20.24 of the El Paso City Code. Subject Property: North of Vista del Sol Drive & West of Joe Battle Blvd. Owner: Yolanda S. ORDINANCE 018866 An Ordinance changing the zoning of a portion of Tracts 1C and 17, Section 34, Block 79, Township 2, Texas and Pacific Railway Company Surveys, City of El Paso, El Paso County, Texas from S-D (Special Development) to R-5 (Residential). The penalty is as provided for in Chapter 20.24 of the El Paso City Code. Subject Property: South of Montana Avenue and West of Rich Beem Boulevard. Property Owner: City of El Paso. PZRZ18-00038

ORDINANCE 018867 An Ordinance amending Chapter 13 (City Parks and Recreation Areas), Section 13.24 (Parks and Recreation Facility Use and Fee Authorization) of the El Paso City Code.  In particular, Chapter and Section 13.24.200 - adding a new subsection F, to establish a cost recovery rate for Sports Complexes.

ORDINANCE 018868 An Ordinance amending Title 12 (Vehicles and Traffic), Chapter 12.88 (Schedules), Section 12.88.200 (Schedule XVII - Restriction on parking in residential districts), Subsection Zone K (No parking 7:00 a.m. to 4:00 p.m., school days only), to add Darway Drive; Cartway Lane; and Eastridge Drive.  The penalty being as provided in Section 12.84.010 and 12.44.280 (S) of the El Paso City Code.

ORDINANCE 018869 An Ordinance approving a Project and Financing Plan for Tax Increment Reinvestment Zone Number Thirteen, City of El Paso, Texas; making various findings related to such plan; identifying the tax increment to be contributed to the Zone’s Tax Increment Financing Fund; providing for severability; and providing an effective date.

ORDINANCE 018870 An Ordinance authorizing the issuance of “City of El Paso, Texas, Water and Sewer Revenue Refunding Bonds, Series 2018,” in an amount not to exceed $30,000,000 to refund certain previously issued obligations of the City and resolving matters which are necessary to effect such issuance, including a delegation of authority.

NOTICE OF INTRODUCTION

Pursuant to Section 3.9A of the El Paso City Charter, the following Ordinances were properly introduced at a Regular Council Meeting on OCTOBER 30, 2018:

  1. An Ordinance authorizing the City Manager to sign a land exchange agreement, deed and any other documents necessary to convey to FSW Investments, LP, approximately 2,313 acres situated in multiple portions of the Texas and Pacific Railroad Company Surveys in the Northeast section of the City of El Paso in exchange for land owned by FSW Investments, LP and located in the Northwest section of the City of El Paso.

PUBLIC HEARING WILL BE HELD ON NOVEMBER 13, 2018 FOR ITEM 1

  1. An Ordinance changing the zoning of Tract 42, S.A & M.G Railway Company Survey No. 267, 235 Hillview Avenue, City of El Paso, El Paso County, Texas from R-4 (Residential) to A-2 (Apartment) and imposing a condition. The penalty is as provided for in Chapter 20.24 of the El Paso City Code. Subject Property: 235 Hillview Ave. Property Owner: Norma Yague PZRZ18-00023
  2. An Ordinance granting a Special Permit No. PZST18-00010, to allow for a ballroom on the property described as A portion of Lot 1, Block 1, Yarbrough Village, 550 Yarbrough Rd., an addition to the City of El Paso, El Paso County, Texas, Pursuant to Section 20.10.240 of the El Paso City Code. The Penalty is as provided for in Chapter 20.24 of the El Paso City Code. Subject property: 550 Yarbrough Rd. Owner: River Oaks Properties LTD. PZST18-00010 (District 7) This case is related to rezoning (PZRZ18-00032) & special condition release (PZCR18-00004).
  3. An Ordinance changing the zoning of A portion of Lot 1, Block 1, Yarbrough Village, 550 Yarbrough Rd., an addition to the City of El Paso, El Paso County, Texas from C-1/sc (Commercial/special contract) to C2 (Commercial). The Penalty is as provided for in Chapter 20.24 of the El Paso City Code. Subject property: 550 Yarbrough Rd. Owner: River Oaks Properties LTD. PZRZ18-00032 (District 7) This case is related to special permit (PZST18-00010) & special condition release (PZCR18-00004).
  4. An Ordinance releasing all conditions placed on property by Ordinance No. 7422, Dated March 2, 1982 which changed the zoning of A portion of Lot 1, Block 1, Yarbrough Village, 550 Yarbrough Rd., an addition to the City of El Paso, El Paso County, Texas. The penalty is as provided for in Chapter 20.24 of the El Paso City Code. Subject Property: 550 Yarbrough Rd. Owner: River Oaks Properties LTD. PZCR18-00004 (District 7) This case is related to special permit (PZST18-00010) & rezoning (PZRZ18-00032).
  5. An Ordinance changing the zoning of Tract 14, Dorbandt Subdivision, 171 Polo Inn Road, City of El Paso, El Paso County, Texas from R-F (Ranch and Farm) to R-4 (Residential). The penalty is as provided for in Chapter 20.24 of the El Paso City Code. Subject Property: 171 Polo Inn Road. Property Owner: Catholic Diocese of El Paso. PZRZ18-00036
  6. An Ordinance granting Special Permit No. PZST17-00036, to allow for a 50 ft. Ground-mounted Personal Wireless Service Facility on the property described as a portion of Lot 3, Block 12, East Glen, 11109 Sam Snead Drive, City of El Paso, El Paso County, Texas, pursuant to Section 20.10.455 of the El Paso City Code.  The penalty being as provided in Chapter 20.24 of the El Paso City Code.
